By accessing or using the MeVana platform ("Platform") and the services provided therein ("Services"), you agree to be bound by these terms and conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Platform or Services. These Terms constitute a legally binding agreement between you ("User" or "you") and MeVana ("Company," "we," or "us").

2.1 Legal Capacity

The Services are intended for individuals who are legally capable of forming binding contracts under applicable law. By using the Platform, you represent and warrant that you have the legal capacity to enter into these Terms.

2.2 Minors

If you are a minor (under the age of 18 or the age of legal majority in your jurisdiction), you may use the Platform only with the involvement and consent of a parent or guardian who agrees to be bound by these Terms.

3.1 Account Responsibility

You are responsible for maintaining the confidentiality of your account information, including your username and password, and for all activities that occur under your account. You agree to notify MeVana immediately of any unauthorized use of your account or any other breach of security.

3.2 Prohibited Uses

Unauthorized use of the Platform is strictly prohibited. You agree not to:

• Use the Platform for any illegal or unauthorized purpose.
• Interfere with or disrupt the operation of the Platform or the servers or networks connected to the Platform.
• Transmit any worms, viruses, or any code of a destructive nature.

4.1 Third-Party Registered Medical Practitioners (RMPs)

MeVana facilitates healthcare services through third-party registered medical practitioners ("RMPs"). These RMPs are independent contractors and not employees of MeVana. MeVana does not provide telemedical consultations directly.

4.2 Informational Purposes

All information provided on the Platform is for informational purposes only and does not constitute professional medical advice, diagnosis, or treatment. Users should not rely on this information as a substitute for, nor does it replace, professional medical advice, diagnosis, or treatment.

4.3 No Doctor-Patient Relationship

Use of the Platform does not create a doctor-patient relationship between you and any RMP. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

5.1 Accuracy of Information

You agree to provide accurate, current, and complete information about yourself as requested by MeVana. MeVana does not validate the accuracy of this information.

5.2 Adherence to Instructions

You must adhere to any prescribed instructions provided by RMPs through the Platform. Notify MeVana promptly of any inconsistencies or issues with the Services.

6.1 No Warranty

MeVana does not guarantee that the Services will meet your requirements or be uninterrupted, timely, secure, or error-free. The Services are provided "as is" and "as available" without any warranties of any kind, either express or implied.

6.2 Limitation of Liability

To the fullest extent permitted by law, MeVana shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:

• The use or inability to use the Services.
• Any unauthorized access to or alteration of your transmissions or data.
• Any other matter relating to the Services.

7.1 Independent Contractors

Consultations facilitated through the Platform are conducted by RMPs who are independent contractors. MeVana is not responsible for and does not assume any liability for the actions, omissions, or negligence of these RMPs.

7.2 Emergency Situations

The Services are not intended for use in emergency situations. If you are experiencing a medical emergency, call your local emergency services immediately. You are responsible for seeking immediate professional medical advice for any critical health situations.

8.1 Data Access and Monitoring

MeVana may access and monitor user data for quality assurance and improvement of Services. User data will be handled in accordance with MeVana's Privacy Policy, which you agree to by using the Platform.

8.2 Data Confidentiality and Security

MeVana is committed to protecting the confidentiality and security of your personal data. We implement appropriate technical and organizational measures to safeguard your data against unauthorized access, disclosure, alteration, or destruction.

9.1 Ownership

All content on the Platform, including but not limited to text, graphics, logos, images, software, and audiovisual materials, is the property of MeVana or its licensors and is protected by copyright, trademark, patent, and other intellectual property laws.

9.2 Restrictions on Use

You may not copy, modify, distribute, sell, or lease any part of the Platform or its content without MeVana's prior written consent. Unauthorized use of the Platform or its content is strictly prohibited.

10.1 Approved Organizations

The following organizations may link to our website without prior written approval:

• Government agencies
• Search engines
• News organizations
• Online directory distributors may link to our website in the same manner as they hyperlink to the Websites of other listed businesses
• System-wide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our website.

10.2 Linking Criteria

These organizations may link to our home page, to publications, or to other Website information so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement, or approval of the linking party and its products and/or services; and (c) fits within the context of the linking party's site.

10.3 Consideration of Link Requests

We may consider and approve other link requests from the following types of organizations

• Commonly-known consumer and/or business information sources
• Dot.com community sites
• Associations or other groups representing charities
• Online directory distributors
• Internet portals
• Accounting, law, and consulting firms
• Educational institutions and trade associations.

10.4 Approval Conditions

We will approve link requests from these organizations if we decide that: (a) the link would not make us look unfavorably to ourselves or to our accredited businesses; (b) the organization does not have any negative records with us; (c) the benefit to us from the visibility of the hyperlink compensates the absence of Mevana; and (d) the link is in the context of general resource information.

10.5 Linking Permissions

These organizations may link to our home page so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement, or approval of the linking party and its products or services; and (c) fits within the context of the linking party's site.

10.6 Notification of Link Requests

If you are one of the organizations listed in paragraph 2 above and are interested in linking to our website, you must inform us by sending an e-mail to [support@mevana.in].  Please include your name, your organization name, contact information as well as the URL of your site, a list of any URLs from which you intend to link to our website, and a list of the URLs on our site to which you would like to link. Wait 2-3 weeks for a response.

10.7 Approved Linking Methods

Approved organizations may hyperlink to our website as follows:

• By use of our corporate name
• By use of the uniform resource locator being linked to
• By use of any other description of our website being linked to that makes sense within the context and format of content on the linking party's site.

10.8 Restrictions on Linking

No use of Mevana's logo or other artwork will be allowed for linking absent a trademark license agreement.

MeVana reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. It is your responsibility to review these Terms periodically for updates.

These Terms and any disputes arising from or related to them shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding related to these Terms shall be brought exclusively in the courts located in India, and you consent to the jurisdiction of such courts.

You agree to indemnify, defend, and hold harmless MeVana, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Platform or Services.
• Your violation of these Terms.
• Your violation of any rights of a third party, including but not limited to intellectual property rights.

MeVana reserves the right, in its sole discretion, to terminate or suspend your access to the Platform and Services, without prior notice or liability, for any reason, including but not limited to your breach of these Terms. Upon termination, your right to use the Platform and Services will immediately cease.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms shall continue in full force and effect.

These Terms, together with the Privacy Policy and any other legal notices published by MeVana on the Platform, constitute the entire agreement between you and MeVana regarding your use of the Platform and Services, and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and MeVana.
